This Privacy Policy describes how Overclock Labs Inc. and its affiliates ("Akash," "we," "our," or "us") may collect, use, and disclose personal information about you. This Privacy Policy applies to information collected when you interact with the website located at http://akashml.com/ (the "Website") and the application interface located at http://playground.akashml.com/ and all related components (the "Platform," or "AkashML"), services provided by Akash described below, including without limitation our generative AI services for image generation, text-to-speech, voice cloning, and audio transcription, and such other services, software, applications, features, or products provided by Akash from time to time (together with the Platform, the "Services"). If you use voice cloning, voice library, or text-to-speech features, you also agree to and are bound by our Biometric Data Notice and Consent, available at akashml.com/biometric-notice. Capitalized terms not defined but otherwise used herein shall have the meaning ascribed to them in our Terms of Service.

In connection with using or accessing the Services, we may collect the following categories of information:
Information you share with us will be transmitted using industry-standard encryption in transit (TLS) and stored using industry-standard encryption methods at rest, with additional access controls applied at the database layer. Voice Samples and Voiceprints are encrypted in transit and at rest, stored in access-controlled storage segregated from other user data, and accessible only to authorized personnel and systems with a documented operational need. As discussed in our Terms of Service, the Services are hosted on the Akash Network, a decentralized compute network operated by third-party node operators. The third-party AI models available through the Services are hosted by the third-party compute providers that participate in the Akash Network. For voice cloning, text-to-speech, image generation, and transcription features, inference may be performed on infrastructure operated by such third-party providers; in all cases, Voice Samples and Voiceprints are processed in encrypted form and providers are contractually prohibited from retaining or repurposing such data.
We may aggregate or de-identify information so that it can no longer identify you, as defined under applicable laws. We may use and/or disclose aggregated or de-identified information for any purpose unless an applicable law says otherwise. We do not aggregate or use Voiceprints or biometric data for any purpose other than providing the voice features you have requested and our limited legitimate operational purposes (security, fraud prevention, abuse detection, and compliance with legal obligations).
Except as described in this Privacy Policy, we do not retain text prompts or transient API inputs you submit to third-party AI models available through the Services after the request has been processed. If a request fails, inputs may be logged briefly by a third-party logging system we use to troubleshoot errors and are deleted in accordance with our retention schedule. The foregoing does not apply to (i) Voice Samples and Voiceprints you affirmatively save to your voice library, which are retained as described in Section 13; (ii) Outputs (including generated images, synthesized audio, and transcripts) that you affirmatively save to your User Account; (iii) content you submit to us for content moderation review; or (iv) any data we are required to retain to comply with legal obligations or to investigate suspected violations of our Terms of Service.
Sensitive and Special Category Data. Some information you may choose to input into the Services may be considered "special," "sensitive," or otherwise heightened under applicable law, including information concerning race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, health, genetic and biometric data, or precise geolocation. With respect to biometric data specifically (including Voice Samples and Voiceprints), we collect, use, store, and disclose such data only with your separate, express, informed, written consent, and only for the specific purposes disclosed to you at the point of collection. Where applicable, our biometric data practices are further governed by our Biometric Data Notice and Consent available at akashml.com/biometric-notice. You may withdraw consent and request deletion of your Voice Samples and Voiceprints at any time as described in Section 7 (Your Choices).

Specific Purpose Limitation for Biometric Data. We use Voice Samples and Voiceprints solely to (i) provide the voice cloning, text-to-speech, transcription, and related features you have requested, (ii) maintain the security and integrity of those features (including detecting unauthorized use), (iii) comply with our legal obligations, and (iv) defend or pursue legal claims. We do not sell biometric data, share biometric data with third parties for their independent use, use biometric data for advertising or profiling, or use biometric data to train AI models.
The Services may contain links to third-party sites, materials, and/or services ("Third-Party Service(s)") that are not owned or controlled by us, and certain functionalities of the service may require your use of Third-Party Services. If you use a Third-Party Service in connection with the service, you are subject to and agree to, and must comply with, the third party's terms and conditions made available via, or agreed in connection with, its services. We do not endorse or assume any responsibility for any Third-Party Services. If you access a Third-Party Service from the service or share your User Content on or through any Third-Party Service, you do so at your own risk, and you understand that these terms and our privacy notice do not apply to your use of any third-party service. You expressly relieve us from any and all liability arising from your access to and/or use of any Third-Party Service.

You should know the ways we share your information and why we share your information. In connection with our Everyday Business Activities, we may share information collected from or about you in the following circumstances:
Biometric Data — Limited Disclosure. Notwithstanding the foregoing, we do not disclose, redisclose, sell, lease, or otherwise disseminate your Voice Samples or Voiceprints except: (i) to our processors strictly to provide the voice features you have requested, under contract terms imposing equivalent protections; (ii) where the disclosure is required by valid legal process (such as a subpoena or court order); (iii) where the disclosure is necessary to complete a financial transaction you initiated or to comply with a warrant or court order; or (iv) with your separate, written consent. We do not sell biometric data.
Like most other online services, we use cookies and similar technologies to collect some of the data discussed in this Privacy Policy. These help us provide certain features to you and analyze usage information. We use Google Analytics (provided by Google LLC) to collect information about how visitors use our website. Google Analytics uses cookies to collect data such as pages visited, time spent on site, browser type, and approximate geographic location. This data is processed by Google and helps us understand usage patterns and improve the Services. Google Analytics data is only collected after you provide consent via the cookie banner on our site. Google Analytics is not used in connection with our voice cloning, text-to-speech, image generation, or transcription features, and no Voice Samples, Voiceprints, prompts, or generated outputs are shared with Google Analytics or any other analytics provider.

Your personal information may be transferred to, processed and stored in countries other than the country in which you are resident. If you are located outside of the United States, your information is collected in your country and may be transferred to another country in which we (or our affiliates or service providers) operate. If we transfer your data out of the European Economic Area ("E.E.A."), we implement at least one of the following safeguards:
With respect to Voice Samples and Voiceprints transferred internationally, additional safeguards apply, including encryption in transit and at rest, contractual prohibitions on retention beyond the request lifecycle, and prohibitions on use for any purpose other than fulfilling your request.
In some jurisdictions like the European Union and the E.E.A., we only collect, use, or share information about you when we have a valid reason. This is called a "lawful basis." Specifically, this is one of the following:
Special Note on Biometric Data Under GDPR. Voice Samples and Voiceprints constitute "special category" biometric data under Article 9 GDPR. We process such data only on the basis of your explicit consent provided at the point of collection (Article 9(2)(a) GDPR). You may withdraw that consent at any time as described in Section 7(F), without affecting the lawfulness of processing carried out before withdrawal. We do not rely on "legitimate interests" as a basis for processing biometric data.

Illinois Residents (BIPA). Illinois law (the Biometric Information Privacy Act, 740 ILCS 14) gives Illinois residents specific rights with respect to biometric identifiers and biometric information. We collect Voice Samples and Voiceprints only after providing you with written notice of (i) the fact that biometric data is being collected or stored; (ii) the specific purpose and length of term for which the data is being collected, stored, and used; and (iii) obtaining your written release. Our retention schedule and destruction practices are set forth in Section 13. We do not sell, lease, trade, or otherwise profit from your biometric data.
Texas Residents. Texas law (Capture or Use of Biometric Identifier Act, Tex. Bus. & Com. Code § 503.001) provides parallel rights to Texas residents.
Washington Residents. Washington's biometric privacy law (RCW 19.375) provides parallel rights to Washington residents.
California Residents. Voice Samples and Voiceprints constitute "sensitive personal information" under the CCPA/CPRA. California residents have the right to limit the use and disclosure of sensitive personal information to those purposes specified in this Privacy Policy. To exercise this or any other right under the CCPA/CPRA, email [email protected].
California's "Shine the Light" law (Civil Code § 1798.83) permits users of our Website that are California residents to request certain information regarding our disclosure of personal information to nonparties for their direct marketing purposes.
Some states like Colorado, Connecticut, Virginia, and Utah each provide their state residents with rights to confirm processing, access, delete, port, and opt out of targeted advertising and sales.
Nevada provides its residents with a limited right to opt-out of certain personal information sales. We do not currently sell data triggering that statute's opt-out requirements.
We use reasonable procedural, physical, and electronic safeguards to protect your information from unauthorized access or use. With respect to Voice Samples and Voiceprints, we maintain a written information security program that includes encryption in transit and at rest using industry-standard cryptographic methods, role-based access controls limiting access to authorized personnel with documented operational need, audit logging of all access to biometric data, segregated storage from other user data, and regular security assessments. These safeguards are designed to be at least as protective as those we apply to other categories of personal information.
The safety and security of your information also depends on you. Do not share your passwords, access credentials, or any secret information with anyone.
We retain personal information only for as long as necessary to provide the Services, fulfill our legal obligations, enforce our legal agreements, and resolve disputes. We apply the following retention practices:
The text-to-speech and voice cloning models we use require the source audio file (a Voice Sample) and/or the derived voice model (a Voiceprint) to remain accessible in order to synthesize new speech in your chosen voice. Deleting the underlying Voice Sample or Voiceprint means the corresponding voice can no longer be used to generate audio. Accordingly, so long as you choose to keep a voice in your voice library, we retain the associated Voice Sample and Voiceprint so that the voice cloning and text-to-speech features remain functional for you.
In compliance with the Illinois Biometric Information Privacy Act (740 ILCS 14/15(a)) and other applicable laws, we maintain the following written retention and destruction schedule for biometric data:
Destruction is effected by cryptographic erasure of encryption keys protecting the data, followed by overwriting of underlying storage in accordance with industry standards. Logs of all biometric data destruction events are retained for audit purposes.
The Services may be used by Minors (individuals between 13 and 17 years of age) only under the supervision and consent of a parent or legal guardian who has read this Privacy Policy and our Terms of Service. Users under 13 may not access the Services under any circumstances. We do not knowingly collect or solicit personal information from children under 13. If we become aware that we have collected personal information from a child under 13, we will promptly delete such information.
Voice and Image Features — 18+ Only. Notwithstanding the foregoing, voice cloning, voice library, text-to-speech, and image generation features are available only to users who are at least 18 years of age. We do not knowingly create Voiceprints of, or generate AI imagery, audio, or text that depicts, any individual under the age of 18, regardless of consent, and our Acceptable Use Policy expressly prohibits any such use.
We are always improving our products and services, and we create new features regularly. These updates sometimes require us to collect new information or use what we already have differently. When we make a material change — for example, the introduction of a new category of data collection (such as biometric data) or a material expansion of our use of an existing category — we will provide notice to registered users at least thirty (30) days before the change takes effect, and we will obtain renewed consent before processing such data under the new terms.
The Services may contain links, banners, or widgets to third party sites, applications, and services. Any information you provide to third parties on their sites or services is covered under their privacy and data collection practices and not covered by this Privacy Policy.
