Why this notice exists. This notice is provided in compliance with the Illinois Biometric Information Privacy Act (740 ILCS 14, "BIPA"), the Texas Capture or Use of Biometric Identifier Act (Tex. Bus. & Com. Code § 503.001), the Washington Biometric Privacy Act (RCW 19.375), Article 9 of the EU and UK General Data Protection Regulation, the California Consumer Privacy Act / California Privacy Rights Act, and other applicable laws governing biometric information. By using AkashML's voice cloning, voice library, or text-to-speech features, you are providing biometric data, which is treated specially under these laws. Please read this notice carefully before proceeding.
1. What We Collect
If you use our voice cloning or voice library features, AkashML (operated by Overclock Labs Inc.) will collect and store:
- Voice Samples — the audio recordings you upload to the Services for the purpose of creating a synthetic voice clone.
- Voiceprints — the mathematical representations or models we derive from your Voice Samples that allow us to synthesize new audio in a voice that resembles the source.
Voice Samples and Voiceprints are "biometric identifiers" and "biometric information" under BIPA and analogous laws, "sensitive personal information" under the CCPA/CPRA, and "special category data" under GDPR.
2. Why We Collect It
We collect, store, and use Voice Samples and Voiceprints solely to:
- Provide the voice cloning, voice library, and text-to-speech features you have requested;
- Maintain the security and integrity of those features (including detecting unauthorized use or abuse);
- Comply with our legal obligations; and
- Defend or pursue legal claims, where applicable.
We do NOT: (a) sell, lease, trade, or otherwise profit from your biometric data; (b) share your biometric data with advertisers, analytics providers, or other third parties for their independent use; (c) use your biometric data to train, fine-tune, or improve any AI model, whether ours or any third party's; or (d) use your biometric data for any purpose not disclosed in this notice and our Privacy Policy.
3. Why We Keep Your Voice On File
The text-to-speech and voice cloning models we use require the source audio file (the Voice Sample) and/or the derived voice model (the Voiceprint) to remain accessible in order to synthesize new speech in your chosen voice. If we delete the Voice Sample or Voiceprint, the corresponding voice can no longer be used. Accordingly, so long as you choose to keep a voice in your voice library, we keep the Voice Sample and Voiceprint on file so the feature continues to work for you. You are in control: any voice you no longer want stored can be deleted at any time.
4. How Long We Keep It
In compliance with BIPA § 15(a) and analogous laws, we maintain the following written retention and destruction schedule for Voice Samples and Voiceprints:
- User-controlled. Voice Samples and Voiceprints are retained for as long as you choose to keep them in your voice library. You may delete any voice at any time through your voice library settings. Deletion is permanent and the voice cannot be reconstructed.
- On deletion request. If you delete a voice or withdraw your consent, the applicable Voice Sample and Voiceprint (and all backup and archive copies) will be permanently deleted within thirty (30) days.
- On account closure. If you close your User Account, all Voice Samples and Voiceprints associated with the account will be permanently deleted within thirty (30) days, except where we are required to retain specific records pursuant to legal process.
- Inactivity safety valve. If your User Account is inactive for thirty-six (36) consecutive months — meaning no logins, API calls, or other authenticated activity — we will email you. If you do not reactivate the account or affirmatively confirm continued retention within thirty (30) days following that notice, we will permanently delete all Voice Samples and Voiceprints associated with your account.
- Outer limit. In all cases, Voice Samples and Voiceprints will be permanently deleted no later than the earlier of (i) the date on which the initial purpose for collection has been satisfied or (ii) the date required by applicable law. We treat your continuing maintenance of a voice in the voice library as ongoing satisfaction of the initial purpose for retention.
5. How We Protect It
We protect Voice Samples and Voiceprints using safeguards that are at least as protective as those we apply to other categories of personal information, including:
- Encryption in transit (TLS) and at rest (AES-GCM 256-bit or equivalent);
- Role-based access controls limiting access to authorized personnel with documented operational need;
- Audit logging of all access to biometric data;
- Storage segregated from other user data; and
- Regular security assessments.
6. Your Rights
You may, at any time and free of charge:
- Review and download your Voice Samples and Voiceprints through your account voice library settings;
- Delete any Voice Sample or Voiceprint;
- Withdraw consent for our collection, storage, and use of biometric data (which will result in deletion of all your Voice Samples and Voiceprints); and
- Restrict use of specific Voiceprints (e.g., disable automated synthesis).

7. Special Rules for Voices of Other People
IF YOU UPLOAD A VOICE THAT IS NOT YOUR OWN, YOU MUST HAVE THAT PERSON'S SEPARATE, EXPRESS, WRITTEN CONSENT.
Specifically, you represent and warrant that, before uploading any Voice Sample of any person other than yourself, you have obtained from that person separate, express, written consent that:
- Identifies AkashML and Overclock Labs Inc. by name;
- Describes the specific purpose for which the voice will be used;
- Authorizes creation and storage of a Voiceprint;
- Authorizes synthesis of new audio in that person's voice using the Voiceprint; and
- Is signed (including by electronic signature) and dated by that person.
You must retain a copy of any such third-party consent for at least three (3) years after the corresponding Voiceprint is no longer stored on our Services, and you must produce a copy on our reasonable request. This protects both you and the person whose voice you uploaded.
8. Voices of Minors
VOICE CLONING AND THE VOICE LIBRARY ARE ONLY FOR USERS WHO ARE 18 YEARS OF AGE AND ABOVE.
Regardless of consent, you may not upload Voice Samples of, or generate Voiceprints from, any person under the age of 18 (including yourself if you are under 18). We will delete any Voiceprints we discover were created from a minor.
9. Prohibited Uses
You may not use Voiceprints or synthesized audio generated through the Services to:
- Impersonate any person for fraud, theft, identity theft, social engineering, or financial scams;
- Generate, distribute, or otherwise exploit any synthetic voice, voice clone, audio recording, or audio output that infringes, misappropriates, or otherwise violates any third party's intellectual property rights, including without limitation copyrights, trademarks, rights of publicity, name, image, likeness, or voice rights;
- Generate sexually explicit content using any real person's voice;
- Defame, harass, or threaten any person;
- Disseminate false information about any candidate, public official, or other public figure;
- Generate any synthetic audio in violation of any applicable law, including the Federal TAKE IT DOWN Act, the Tennessee ELVIS Act, California Civil Code §§ 3344 / 1708.86, or any other right-of-publicity, deepfake, or deceptive-practices law; or
- Disclose synthetic audio in a manner that fails to indicate its synthetic nature where such disclosure is required by law.
10. Disclosures to Third Parties
We disclose Voice Samples and Voiceprints only:
- To processors strictly to provide the voice features you have requested, under contract terms imposing equivalent protections, including a prohibition on retention beyond the request lifecycle and a prohibition on use for any other purpose;
- Where the disclosure is required by valid legal process (subpoena, court order, search warrant);
- To complete a financial transaction you initiated, where applicable; or
- With your separate, written consent.
We do not sell biometric data.
